A few days ago, Judge Elda Machuga Aliaga, head of the Sixth Justice of the Peace Court of Cajamarca Province, resolved a child-support case involving a former couple with hearing disabilities and their children. The claimant was assisted by the Public Defender’s Office of the Ministry of Justice, while the respondent received support from the Free Legal Clinic of the National University of Cajamarca.
The proceeding, which was completed in record time in a single session because of COVID-19, included sign-language interpreting provided by Cinthya Marilyn Gallardo, who facilitated communication during the final decision. The case concluded with a settlement benefiting the couple’s two children. It should be noted that the interpreter’s work was appropriately arranged, as she was positioned in a suitable place with adequate lighting to facilitate interaction with the parties.
The court also ordered the immediate processing of the document required to open a child-support account at Banco de la Nación in favor of the claimant for payment and collection of all support installments.
This action is consistent with several criteria established in subsection 4.1, “Assistance to Persons with Hearing Disabilities,” of the Judicial Assistance Protocol for Persons with Disabilities implemented by the Judiciary. Events such as these bring us closer to genuine inclusion, although we recognize that there is still a long way to go.
