On January 3, 2020, Supreme Decree No. 001-2020-TR was published, approving the Guidelines for providing reasonable accommodation to persons with disabilities in the workplace and the criteria for determining a disproportionate or undue burden, applicable in the Public Sector.
This Supreme Decree provides parameters for implementing reasonable accommodation for persons with disabilities in Public Administration entities covered by Article I of the Preliminary Title of the Consolidated Text of Law No. 27444, General Administrative Procedure Act, approved by Supreme Decree No. 004-2019-JUS.
Another important point is that this Supreme Decree determines the circumstances in which an accommodation constitutes a disproportionate or undue burden and therefore may not be granted, as well as which unjustified denials of reasonable accommodation are considered unlawful.
It should also be noted that telework is contemplated as a reasonable accommodation measure.
