Research on artificial intelligence, disability and human rights that analyzes the risks of algorithmic discrimination for persons with disabilities and the protection provided by the principle of equality and non-discrimination.

This research studies the impact that artificial intelligence systems may have on the rights of persons with disabilities, paying particular attention to the role of algorithms and data in producing potentially discriminatory decisions or predictions. The study addresses this issue from the perspective of International Human Rights Law and takes the Convention on the Rights of Persons with Disabilities as a central reference.

The study examines international and regional instruments related to the regulation of artificial intelligence, as well as the risks arising from algorithmic discrimination, stereotyped data and the use of automated systems in areas that affect the exercise of rights. The research also analyzes the relationship between equality and non-discrimination, accessibility, universal design, reasonable accommodation, and participation of persons with disabilities.

Using a theoretical, descriptive and subsequently prescriptive methodology, the study systematizes instruments from the Universal, European, Inter-American and African Human Rights systems, analyzes doctrinal and institutional sources, and proposes a roadmap to strengthen the regulation of artificial intelligence in the face of disability-based discrimination.

The research was submitted as a Master’s Thesis for the University Master’s Degree in Advanced Human Rights Studies at Carlos III University of Madrid, within the Gregorio Peces-Barba Human Rights Institute, under the supervision of Rafael de Asís Roig.
